The Studio Online - Terms of Service

1. About These Terms
These Terms of Service ("Terms") govern access to and use of the website and platform at thestudioonline.co.uk (the "Platform"), operated by Heidi Gardner, trading as The Studio Online ("we", "us", "our"), a sole trader based in England at Crabmill Lane, Norley, Frodsham, WA6 8JN.
By creating an account, subscribing to a class, or otherwise using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.
2. Who Can Use The Studio Online
The Studio Online is for adults only. You must be at least 18 years old to create an account or subscribe. By registering, you confirm you meet this requirement.
3. What The Studio Online Is
The Studio Online connects subscribers with independent Pilates and Barre instructors ("Instructors") who deliver structured, progressive on-demand classes. Subscriptions are per Instructor - subscribing to one Instructor doesn't give you access to another Instructor's classes unless you subscribe to them separately.
Instructors are independent contractors. They are not employees, partners or agents of The Studio Online, and we're not a party to the relationship between you and an Instructor beyond running the Platform and processing payment.
4. Your Account
You need an account to subscribe. You're responsible for keeping your login details secure and for everything that happens under your account. If you think your account's been compromised, tell us straight away at contact@thestudioonline.co.uk.

6. Cancelling
You can cancel any time from your account. Cancellation takes effect at the end of your current billing period - you'll keep access until then, and we don't offer refunds for the unused part of a month.
Under the Consumer Contracts Regulations 2013, you'd normally have a 14-day right to cancel a distance contract for a full refund. Because classes are digital content available to you as soon as you subscribe, confirming your subscription and accessing a class means you're asking us to start immediately and accepting that you lose this 14-day right once you've done so. If you haven't accessed any classes, you may still be able to cancel within 14 days for a refund - contact contact@thestudioonline.co.uk.
Outside of that, subscriptions are non-refundable.
We can suspend or close your account for breaching these Terms, including misusing Content or abusive conduct toward Instructors or other subscribers.
7. Content & Your Licence to Use It
Classes, videos, images and other materials made available through the Platform ("Content") are owned by the Instructor who made them, or licensed to us for hosting, streaming and promotional use.
Subscribing gives you a personal, non-transferable licence to stream Content for your own private use. You can't download, screen-record, redistribute, publicly show, or commercially use any Content.
We can remove Content or an Instructor from the Platform at any time. If an Instructor leaves, subscribers already subscribed to them generally keep access to their existing Content until their next renewal date, unless we need to remove it sooner (for example, for a legal or safety reason).
Any feedback you give us, including the star ratings and comments you leave on a class, goes to the Instructor and to us, not onto any public profile. By leaving it, you allow The Studio Online to use it, in whole or in part, in our own marketing and promotional material. We won't attach your name.
8. Health & Fitness Disclaimer
Pilates, Barre and physical activity generally carry inherent risk. Speak to a doctor or other qualified health professional before starting a new exercise programme, particularly if you're pregnant, have an existing injury, or have a health condition that exercise could affect.
You take part in classes at your own risk. Neither we nor any Instructor is responsible for injury, loss or damage arising from your participation, except where it's caused by our or an Instructor's negligence and to the extent that responsibility can't lawfully be excluded.
Content is for general fitness purposes and isn't medical advice. Instructors are expected to structure classes progressively and make equipment optional, but it's on you to work within your own ability and stop if something doesn't feel right.
9. Merchandise
Merchandise bought through the Platform is sold and fulfilled by The Studio Online. Delivery and returns terms are shown at checkout, including your right to cancel and return physical goods under the Consumer Contracts Regulations 2013.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or anything else the law doesn't allow us to limit.
Subject to the paragraph above, our liability to you for any claim arising from your use of the Platform is limited to the amount you paid us in the 3 months before the claim arose.
We're not liable for indirect or consequential losses, or for the acts or omissions of Instructors, who operate independently of us.
12. Changes to These Terms
We may update these Terms as the Platform develops or the law changes. We'll post the updated version here with a new "last updated" date, and where a change is material, we'll make reasonable efforts to let you know before it takes effect.
13. Governing Law
These Terms are governed by the law of England & Wales, and any disputes are subject to the exclusive jurisdiction of the courts of England & Wales.
